AgentGatePay is currently in BETA release. This means the service is under active development and testing. By using AgentGatePay, you acknowledge and accept the risks and limitations described in this disclaimer.
AgentGatePay does not guarantee service availability. The service:
- May be unavailable at any time for maintenance, updates, or technical issues
- May experience downtime without prior notice
- May be temporarily suspended for any reason
- May be permanently shut down without prior notice or warning
- Is not subject to any Service Level Agreement (SLA)
AgentGatePay reserves the right to:
- Terminate or suspend the service at any time
- Discontinue features or functionality without notice
- Close the project permanently without notice to users
- Make changes to pricing, features, or terms without advance warning
- All data may be lost at any time without recovery
- AgentGatePay does not guarantee data persistence, backup, or recovery
- Users are solely responsible for maintaining their own records and backups
- Transaction history, payment records, and account data may be permanently deleted
- APIs, protocols, and integrations may change without backward compatibility
- Software updates may break existing integrations
- No guarantee of migration paths or upgrade support
AgentGatePay facilitates blockchain-based cryptocurrency payments. Users acknowledge:
- Blockchain transactions are irreversible - lost funds cannot be recovered
- Smart contract risks - potential bugs or vulnerabilities in blockchain protocols
- Network congestion - transactions may fail or be delayed
- Gas fee volatility - transaction costs may vary significantly
- No refunds - AgentGatePay does not provide refunds for completed transactions
AgentGatePay and its operators are NOT LIABLE for:
- Lost cryptocurrency or digital assets
- Failed transactions or payment processing errors
- Unauthorized access to user wallets or accounts
- Market volatility or exchange rate fluctuations
- Regulatory or legal issues arising from cryptocurrency use
- Tax implications of cryptocurrency transactions
- Loss of revenue, profits, or business opportunities
- Indirect, incidental, consequential, or punitive damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
AgentGatePay and its affiliates, officers, directors, employees, agents, and licensors shall NOT BE LIABLE for any:
- Direct damages exceeding the amount paid to AgentGatePay (if any) in the 12 months prior to the claim
- Indirect, incidental, special, consequential, or punitive damages of any kind
- Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Damages resulting from (including but not limited to):
- Use or inability to use the service
- Unauthorized access to or alteration of data
- Statements or conduct of any third party on the service
- Service interruptions, errors, or security breaches
- Blockchain network failures or smart contract bugs
- Regulatory changes or legal compliance issues
AgentGatePay is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to:
- Merchantability - No guarantee the service is fit for commercial use
- Fitness for a particular purpose - No guarantee the service meets your specific needs
- Non-infringement - No guarantee against intellectual property claims
- Accuracy or reliability - No guarantee of error-free operation
- Security - No guarantee against security breaches or data theft
- Availability - No guarantee of continuous or uninterrupted access
- Technical support is provided on a best-effort basis only
- No guaranteed response times for support inquiries
- Support may be discontinued at any time
Users are solely responsible for:
- Security - Protecting their private keys, API keys, and credentials
- Compliance - Ensuring their use complies with applicable laws and regulations
- Risk assessment - Evaluating whether AgentGatePay is suitable for their use case
- Testing - Thoroughly testing integrations before production use
- Backups - Maintaining independent records of all transactions and data

Use of AgentGatePay for illegal activities, fraud, money laundering, or any unlawful purpose is strictly prohibited and may result in immediate account termination and legal action.
By using AgentGatePay during the beta period, you agree to:
- Test the service at your own risk
- Report bugs and issues to help improve the platform
- Accept limitations and acknowledge the experimental nature of the service
- Waive claims for damages arising from beta testing participation
- Understand that beta features may not reach production
You agree to indemnify, defend, and hold harmless AgentGatePay and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the service
- Violation of these terms or applicable laws
- Infringement of third-party rights
- Negligence or willful misconduct
AgentGatePay reserves the right to modify this disclaimer at any time without notice. Continued use of the service after changes constitutes acceptance of the updated terms.
This disclaimer shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the jurisdiction specified in AgentGatePay's Terms of Service.
