DerPlanner - Source Code License

Version 1.0 - January 2025

Dual Licensing Model

This software is available under two different licenses depending on your use case:

  1. Community License (this document) - For non-commercial, educational, and open-source use
  2. Commercial License - For proprietary and commercial use (contact: d.hueckmann@googlemail.com)

COMMUNITY LICENSE TERMS

This project is licensed under a modified Apache License 2.0 with additional restrictions on commercial use and redistribution.

1. Definitions

"License" means the terms and conditions for use, reproduction, and distribution as outlined in this document.

"Licensor" means DomEscobar and any authorized copyright owner(s).

"You" or "Your" means an individual or legal entity exercising permissions granted by this License.

"Source Form" means the preferred form for making modifications, including software source code, documentation, and configuration files.

"Object Form" means any form resulting from mechanical transformation or translation of Source Form.

"Work" means the original software and any derivative works based on the software.

"Commercial Use" means any use of the Work for commercial advantage or private financial gain, including:

  • Selling or licensing derivative works
  • Using the Work as part of a commercial product or service
  • Offering the Work or derivatives as a SaaS, cloud service, or managed service
  • Any use by corporations or for-profit entities
  • Rebranding or reselling the Work without significant modifications

"Non-Commercial Use" means educational, personal, research, or open-source projects where no commercial advantage is gained.

2. Grant of License

Subject to the terms of this License, You are granted a non-exclusive, worldwide, non-transferable license to:

  • Use, study, and learn from the Source Form
  • Modify the Source Form for your own non-commercial purposes
  • Share modifications with the community under this same License
  • Deploy the Work for non-commercial use
  • Distribute the Work with proper attribution

Commercial use is strictly prohibited under this license. For commercial use, you must obtain a Commercial License.

3. Attribution Requirements

You must:

  1. Preserve Notices: Include this LICENSE, the original copyright notice, and attribution to DomEscobar in any copies or derivative works
  2. Provide Notice: In any documentation or public materials, include:
    • A clear statement that the work is based on DerPlanner by DomEscobar
    • A link to the original repository: https://github.com/DomEscobar/Zippy
    • This attribution must be reasonably visible to end users
  3. Modified Works: If you modify the code, clearly indicate what has been changed and maintain an acknowledgment of the original work

4. Restrictions

You may NOT:

  1. Commercial Redistribution: Sell, rent, lease, or otherwise monetize this Work or derivative works without a Commercial License
  2. Proprietary Rebranding: Repackage and resell this Work without significant modifications or substantial added value, regardless of attribution
  3. Competing Products: Use this Work to create a directly competing commercial product without a Commercial License
  4. Obscure Attribution: Bury or de-emphasize attribution to DerPlanner in any distribution
  5. Remove Licenses: Remove or modify any copyright notices, attribution text, or this License from the Work
  6. SaaS/Managed Services: Operate this Work as a service for commercial clients without a Commercial License

5. Commercial License

For commercial use, proprietary distribution, or SaaS deployments, you must obtain a Commercial License from the Licensor.

Commercial License includes:

  • Permission for commercial use and redistribution
  • The ability to create proprietary derivatives
  • Support and maintenance (optional)
  • Custom terms negotiated per agreement

6. Derivative Works & Contributions

If you create derivative works under this Community License:

  1. You must distribute them under the same Community License terms
  2. You must prominently attribute DerPlanner as the original source
  3. You must provide the source code to anyone who receives your derivative work
  4. You cannot relicense the derivative work under a more permissive license
  5. You cannot use it as the basis for a commercial product

7. Open Source Contributions

If you contribute improvements to the official DerPlanner repository:

  1. You grant DomEscobar a perpetual, worldwide, non-exclusive license to use your contributions
  2. Your contributions may be used for commercial purposes by the Licensor
  3. Your contributions remain under the Community License in the public repository

8. Warranties & Liability Disclaimer

THE WORK IS PROVIDED "AS-IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

THE LICENSOR SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM USE OF THE WORK, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

You assume all responsibility and risk for your use of the Work.

9. Termination

Your rights under this License are automatically terminated if you:

  1. Violate any terms of this License
  2. Sell or commercially distribute the Work without a Commercial License
  3. Remove or misrepresent the attribution or license terms

Upon termination, you must cease all use and distribution of the Work.

10. Patent Rights

Any patent licenses granted are limited to the non-commercial use permitted by this License. Commercial use patents rights require a Commercial License.

11. Governing Law

This License is governed by the laws of the jurisdiction in which DomEscobar resides, without regard to conflict of law provisions.


SUMMARY OF PERMISSIONS & RESTRICTIONS

✅ You CAN do this (Non-Commercial):

  • Use DerPlanner for personal, educational, or research projects
  • Modify the code for non-commercial purposes
  • Deploy on your own servers (non-commercial)
  • Contribute improvements to the community
  • Share your modifications (under this same License)
  • Run an instance for your team (no external payment)

❌ You CANNOT do this (Without Commercial License):

  • Sell or charge for the software
  • Create a commercial service based on this code
  • Resell/rebrand this work as your own product
  • Use it in a commercial SaaS offering
  • Rent or license it to other businesses
  • Integrate it into a for-profit product without modification

GETTING A COMMERCIAL LICENSE

If you want to:

  • Build a commercial product using DerPlanner
  • Offer it as a SaaS service
  • Resell or rebrand it
  • Integrate it into proprietary software

Commercial licenses are negotiated on a case-by-case basis and may include:

  • Custom terms and conditions
  • Technical support
  • Custom modifications
  • Usage restrictions based on your needs

SPECIAL PERMISSIONS

The following are explicitly permitted under the Community License:

  1. Educational Use: Universities, schools, and educational organizations can use and modify the Work without restriction (non-commercially)

  2. Research Projects: Academic and non-profit research can use the Work and publish results

  3. Internal Use: Organizations can run DerPlanner internally for their employees without a Commercial License (as long as no external service is offered)

  4. Open Source Projects: Other open-source projects can use and build upon DerPlanner under the Community License

Migration from Apache 2.0

This software was previously licensed under Apache 2.0. This Community License supersedes the previous Apache 2.0 license effective immediately. The open-source principles are preserved while adding protections against commercial exploitation.
